Legal language: eiser, dagvaarding, hoger beroep

C1 · Advanced · ≈ 27 min

Legal Dutch turns up more often than you'd think: a letter from a deurwaarder, a municipal decision with the note Bent u het niet eens? Dan kunt u bezwaar maken, news about a hoger beroep in a high-profile case. The words here are precise: vonnis and arrest are both judgments, but from different courts; bezwaar and beroep are both ways of challenging a decision, but at different stages. This lesson sorts out these distinctions.

After moving out, Alex and Nora didn't get their 2,400-euro deposit back. The landlord claimed the floor was damaged. Alex served him a formal notice of default by registered letter: pay within fourteen days.

Nothing happened. So Alex summoned the landlord before the sub-district court. Alex was the claimant, the landlord the defendant. A bailiff served the writ of summons.

At the hearing Alex showed photos of the handover. Four weeks later the judge gave a ruling. The judgment stated that under the tenancy agreement the landlord must repay the deposit, plus interest.

The landlord threatened to appeal, but in the end decided against it. They reached a settlement: he pays in two instalments, provided Alex waives extra legal costs. Alex agreed, without prejudice to his right to go back to court if the second instalment doesn't arrive.
