Law and regulations

The Dutch system is set up so that almost any decision can be challenged — but only by following a strict procedure and within a set timeframe. The difference between bezwaar and beroep, or between boete and dwangsom, is not a linguistic nuance; it's the difference between “it can still be fixed” and “it's too late”.

Alex's neighbour wants to build a large dormer and applies for a permit. Alex is afraid his garden will end up in the shade. As an interested party he may first submit his view.

Still, the municipality makes its decision: the permit is granted. Within the six-week time limit Alex lodges an objection. A hearing follows, where both neighbours tell their side.

The committee finds the objection unfounded: according to the reasoning, the shade is limited. Alex could still appeal to the court, but he doesn't.

A year later it turns out the neighbour built bigger than allowed. That's a violation. The municipality chooses enforcement: the neighbour has to change it, or else a penalty payment of 500 euros a week follows. Turning a blind eye is not an option here, says the alderman.

Challenging a decision

Four steps
StepDutchWhat it is
1het besluitthe authority's decision, this is where it all starts
2het bezwaaran objection to the same authority, within 6 weeks
3het beroepan appeal to the court if the objection was rejected
4het hoger beroepan appeal to a higher court

The six-week period is counted from the date the decision was sent, not received. If you miss it, your objection will not be accepted, no matter how right you are.
